The Website is operated by Junk Happens Inc., carrying on business as Junk Happens GTA ("Junk Happens," "we," "us," or "our"), an Ontario corporation. By accessing or using the Website, you agree to these Terms. If you do not agree, please do not use the Website. 1. Website information only The Website provides general information about our junk removal, property cleanout, renovation cleanout, non-structural interior demolition, tear-out, debris removal, and related services. Website content is provided for general informational purposes and may not describe every service, restriction, fee, or condition that applies to a particular job. Use of the Website does not create a contractor-client relationship, obligate us to accept a job, or guarantee that any service, price, arrival time, or appointment is available. 2. Quote requests and estimates You may request a quote or estimate through the Website, by telephone, text message, WhatsApp, email, or by sending photographs or videos. You agree that the information and images you provide will be accurate and complete to the best of your knowledge. Unless we clearly state otherwise in writing: • Website prices and "starting from" prices are examples only and are not binding offers. • Photo, video, telephone, or online estimates are preliminary and may change after we inspect the items, volume, weight, materials, access conditions, labour requirements, parking, disposal requirements, or other circumstances. • A booking is not confirmed until we expressly confirm it. • Final pricing, scope, payment requirements, cancellation terms, and job-specific conditions will be set out in the applicable estimate, invoice, work authorization, service agreement, or other written confirmation. Applicable taxes and properly disclosed additional charges may be added where required. You may decline a revised price before work begins. Work outside the agreed scope requires further approval. 3. Service limitations We may refuse, suspend, reschedule, or stop work where we reasonably believe that a job is unsafe, unlawful, outside our service scope, materially different from the information provided, or requires licences, equipment, trades, testing, permits, engineering, environmental handling, or precautions that are not included in our agreement. We do not handle every material or project. Prohibited or restricted items may include hazardous, toxic, explosive, biomedical, regulated, concealed, or unusually heavy materials. Acceptance of any item or project is subject to our inspection and written confirmation. Any reference to demolition or tear-out services means only the specific non-structural work agreed to in writing. Structural, electrical, plumbing, gas, asbestos-abatement, mould-remediation, and other regulated work are excluded unless expressly stated in a signed agreement and lawfully performed by qualified parties. 4. Property access and authority When requesting or authorizing services, you represent that you are at least 18 years old and that you own the property and items involved or have the owner's lawful authority to approve access, removal, disposal, donation, recycling, demolition, or other agreed work. You are responsible for identifying items that must not be removed, disclosing known hazards and access restrictions, securing pets and vulnerable persons, and obtaining any permissions required from owners, landlords, condominium Junk Happens Inc. | junkhappens.ca Page 2 corporations, property managers, municipalities, or other parties. 5. Acceptable use You must not: • use the Website for unlawful, fraudulent, abusive, or misleading purposes; • submit content that infringes another person's rights or includes information you are not authorized to share; • attempt to gain unauthorized access to the Website, its systems, or another user's information; • introduce malware, interfere with Website operation, scrape the Website through automated means without permission, or bypass security controls; or • copy, republish, sell, or commercially exploit Website content except with our written permission. 6. Photos and other content you submit You retain ownership of photographs, videos, messages, and other content you submit. You grant us a non-exclusive, worldwide, royalty-free licence to access, store, copy, and use that content only as reasonably necessary to assess your request, communicate with you, provide and document services, resolve disputes, comply with law, and operate our business in accordance with our Privacy Policy. We will not use identifiable customer photos or job-site content in advertising or social media without separate permission, unless the content has been lawfully de-identified so that neither you nor the location is reasonably identifiable. 7. Intellectual property The Website and its text, graphics, designs, logos, photographs, videos, icons, trademarks, and other content are owned by or licensed to Junk Happens and are protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, non-transferable right to access and use the Website for your personal or internal business purpose of considering or obtaining our services. No other rights are granted. "Junk Happens," "Junk Happens GTA," associated logos, slogans, and branding may not be used without our prior written permission. 8. Third-party services and links The Website may link to or integrate third-party services such as maps, messaging platforms, social media, online forms, analytics, scheduling, invoicing, or payment processors. Those services are controlled by their respective providers and may have separate terms and privacy policies. We are not responsible for third-party websites, services, availability, security, or content. 9. Website availability and accuracy We try to keep the Website accurate and available, but we do not guarantee that it will always be current, complete, uninterrupted, secure, or error-free. Limitation of liability To the maximum extent permitted by law, Junk Happens and its directors, officers, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, opportunity, or goodwill, arising from or related to your use of or inability to use the Website. For claims arising solely from use of the Website, our total aggregate liability will not exceed the greater of (a) the amount you paid us specifically for access to the Website during the 12 months before the event giving rise to the claim and (b) CAD $100. This section does not govern liability arising from services performed under a separate service agreement, estimate, invoice, or work authorization, and does not limit liability that cannot legally be limited. 12. Indemnity To the extent permitted by law, you agree to indemnify and hold harmless Junk Happens and its directors, officers, employees, contractors, and representatives from third-party claims, losses, and reasonable costs arising from your unlawful use of the Website, your material breach of these Terms, content you submit without authority, or your infringement of another person's rights. 13. Governing law These Terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law rules. Subject to any mandatory consumer rights, the courts located in Ontario will have exclusive jurisdiction over disputes relating to these Terms or the Website. 14. Changes to these Terms We may update these Terms from time to time. The updated version will be posted on the Website with a revised effective date. Changes apply prospectively when posted unless applicable law requires otherwise. Your continued use of the Website after an update means you accept the revised Terms. 15. General If any provision of these Terms is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent.
